Financial Burden:
In 66% of cases, judges demanded payment for release, with an average bond set at $15,913.69. This puts financial strain on individuals and families, especially if innocence is later proven.
Communication Challenges:
Over 10% of hearings had evident communication issues, exacerbated by virtual hearings where judges and accused struggled to understand each other.
Risk of Self-Incrimination:
In 29% of cases, individuals made statements potentially harmful to their case due to questioning without legal counsel present.
These findings highlight systemic flaws, with judges setting bonds without clear rationale and individuals lacking the guidance necessary to protect their rights. The absence of legal representation during these critical hearings leaves many vulnerable to unjust outcomes.
The ACLU’s report underscores the urgent need for reforms to ensure fair and equitable treatment within Travis County’s criminal justice system.
